2023 Estate Planning Workshop

This Online Workshop took place on 19 April 2023 and the recording is available until 18 April 2024 for those who couldn’t make the live session.

  • Louis van Vuren, CFP® FPSA® will cover Recent developments in Trusts – linking Court Cases applying to a financial planning perspective
  • David Thomson , CFP® FPSA®   and Renate Jute, CFP® FPSA® will have a panel discussion on Practical Pitfalls in Estate Planning which will be moderated by Nici Macdonald, CFP®  

Speakers:

Prof. Fatima Osman

Fatima Osman holds a B.Bus Sci, LLB, LLM, PhD from the University of Cape Town. She is an admitted attorney of the High Court and has practiced as a commercial attorney and acted as a legal advisor before joining academia. She is currently an Associate Professor in the Private Law Department at the University of Cape Town where she lectures African Customary law and is the coordinator of the Academic support programme.

Fatima’s Phd dissertation examined the administration of customary law estates in South Africa, and her research interests lies in field of customary law, succession and human rights. She is particularly interested in the lacunae and complexities and that arise in a legal system with multiple normative orders. She is currently working on an examination of the Intestate Succession Act and Wills Act and potential reforms thereto in light of socio-economic developments and recent developments in case law.

Louis van Vuren, CFP® FPSA®

Louis holds BA, LLB and LLM degrees from RAU (now UJ), the Advanced Certificate in Leadership from UCT and the Advanced Post-Graduate Diploma in Financial Planning (cum laude) from the UFS. He started his professional career as a public prosecutor and state advocate (1984 – 1990).

His career in financial services goes back 33 years, with 27 of these in the fiduciary industry. He served as legal adviser and in management in Old Mutual and in various senior management roles in Old Mutual Trust and BoE Trust, before taking early retirement in 2012.

Louis is the CEO of the Fiduciary Institute of Southern Africa (FISA) and Director: Trust Services of Finlac Risk and Legal Management (Pty) Ltd, a fee-based financial planning practice in Cape Town.

David Thomson , CFP® FPSA®

David is an attorney, having obtained the BA & LLB degrees from the University of KwaZulu Natal in 1984. He is currently employed by Sanlam Trust at head office in Cape Town as a senior Legal Adviser, having previously worked for Broker Distribution as a legal consultant in KZN.
He is a certified financial planner (holding the CFP® mark as a member of the Financial Planning Institute of Southern Africa) and also qualified as a notary & conveyancer. He holds post-graduate qualifications in tax; compliance management & arbitration law.
In 2008 he graduated with the Advanced Higher Diploma in Financial Planning conferred by the University of the Free State, in Estate Planning & Advanced Investments. David has been with Sanlam for 25 years & specialised in estate & retirement planning; trusts & business assurance. He advised clients on behalf of independent financial planners & selected banking intermediaries. Now at Sanlam Trust, he advises the business on all legal matters- including litigation- concerning Wills; Deceased Estates; Trusts & Umbrella Funds. His role at Sanlam Trust also involves drafting service provider contracts; risk management; writing & editing articles for Sanlam publications and external media concerning estate planning and related matters and developing analysis tools for financial planners.

David is the chairman of the FPI competency committee regarding Estate Planning & Trusts and a member of the FPI Disciplinary committee- having previously served as chairman. He was previously a member of the FPI Advocacy committee and served on the KZN regional committee for some years.

He was elected to the main board of the FPI in 2012 (non- executive) and was re-elected in May 2014 and served until the expiry of his term in 2017.

He is also a member of the Law Society of SA & a registered tax practitioner. David is an advocate of positioning the Financial Planning Institute & the CFP® designation as an aspirational brand & the standard- setter for excellent financial planning for all in South Africa.

Renate Jute, CFP® FPSA®

Renate has been actively involved in the Financial Services industry for over 20 years and is a CERTIFIED FINANCIAL PLANNER® and Tax Practitioner.

Renate is a member of FPI (Financial Planning Institute of South Africa), SAIT (South African Institute of Tax), and FISA (Fiduciary Institute of Southern Africa).

Renate started her Trust Administration career in 2001 and later branched out into Estate Planning and Administration and is the founder of Noble Prosperity PTY.

Renate has a passion for data, research, and entrepreneurship. She believes in leaving it better than we found it, she also has several qualifications, including a degree in Psychology, a Post Graduate Diploma in Financial Planning, Estate Administration and Coaching.

Nici Macdonald, CFP®

Nici is the current Head of Certification at the Financial Planning Institute. She has extensive industry experience as a financial planner and practice manager. Her previous roles also include advising clients on fiduciary matters. For many years Nici was also closely involved with the University of the Free State in setting of examination papers, developing study material and online lecturing for the Diploma in Estate and Trust Administration.

Nici holds a Master’s Degree in Private Law from the University of the Free State and an Advanced Postgraduate Diploma in Financial Planning. She is a member of the FPI and FISA.
